Find Your Tribe LLC ("we," "us," "our")

1. Our Role

Summary: We provide a platform for users to connect, but we do not control what users do or post. You are responsible for your own actions and decisions.

We operate a platform enabling users to create profiles, post and discover meetups, and message each other (our "Services"). We are a technology provider only and do not create, supervise, or control user content, meetups, or interactions. This means we are not liable for user-submitted content or conduct – under laws like the U.S. Communications Decency Act, we are not considered the publisher of what users post. You are solely responsible for your decisions and actions both on the Services and in real life. We do not guarantee any specific outcomes from using the platform.

2. Eligibility

Summary: You must be an adult (21 or older) legally capable of agreeing to this contract.

You must be 21 years of age or older to use the Services, and be legally able to enter into this agreement. The Services are intended solely for adults; we do not knowingly permit anyone under 21. By using the Services, you represent that you meet these eligibility requirements. We may implement age verification or other checks to enforce this policy.

3. Account & Security

Summary: Provide accurate info and keep your account secure. You're responsible for anything that happens under your account.

When creating an account, you agree to provide truthful, current information (such as your name, valid email, and age confirmation). You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password or let others access your account. You're responsible for all activities that occur under your account. If you suspect unauthorized use of your account, notify us immediately. We may require verification of your email or phone number to activate or continue using an account for security purposes.

4. Your Content & License

Summary: You own the content you post, but give us permission to use it to provide and improve our Services, and to enforce our rules.

You retain ownership of all content that you post or upload on the Services (your photos, text, event listings, etc.). However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, modify (for technical display optimization), publicly display, distribute, and create derivative works from your content as needed to operate, improve, and promote the Services, and to enforce these Terms and our policies. This license is for the limited purpose of running the platform (for example, storing your photos on our servers and showing them to users, or analyzing content to improve features or safety). We do not claim ownership of your content, and this license ends when you delete the content from our Services (except to the extent others have already viewed or shared it, or it's retained in backup copies for a limited time).

You are responsible that your content complies with these Terms and that you have the necessary rights to post it. We have the right (but not the obligation) to review and remove content that violates the law or these Terms.

5. Prohibited Conduct

Summary: Be respectful and lawful. Don't use our platform to do bad things – no illegal, harmful, or offensive content or behavior.

You agree not to engage in any of the following prohibited activities on the Services:

  • Illegal Acts: Posting anything unlawful or encouraging illegal behavior.
  • Harassment/Hate: Harassing, bullying, or threatening others; or using hateful or discriminatory language targeting someone's race, ethnicity, national origin, religion, disability, disease, sex, gender, sexual orientation, or age.
  • Sexually Explicit or Exploitative Content: No pornographic or sexually explicit material. No content that exploits or endangers anyone, especially minors. Absolutely no content involving sexual activities or nudity of any person under 18.
  • Violence: No depiction or encouragement of gratuitous violence or violent extremism.
  • Doxxing/Privacy: Do not share others' personal or sensitive information without consent.
  • Scams/Fraud/Spam: No fraudulent schemes, impersonation of others, phishing, or unsolicited bulk communications.
  • Impersonation: Do not impersonate any person or entity or misrepresent your affiliation.
  • Intellectual Property Infringement: Do not post content that you do not have the right to post. Respect copyrights, trademarks, and other proprietary rights.
  • Reverse Engineering or Misuse: Do not attempt to scrape, crawl, hack, or reverse-engineer any part of the Services.
  • Unsafe Activities: You may not organize or encourage events or activities that are illegal, dangerous, or highly risky.

We reserve the right to define and modify what content or behavior is considered prohibited, in line with applicable law and community standards.

6. Meetups, Safety & Assumption of Risk

Summary: Meeting people in real life involves risks. You are responsible for your safety. We don't conduct background checks or guarantee anyone's trustworthiness. By using our app and attending meetups, you accept the risks, and you won't hold us liable for what happens at those events.

Our platform helps you connect with others and organize or attend meetups. You alone decide whether, when, and how to interact with or meet someone. Use common-sense safety precautions when arranging in-person meetings (for example, meet in a public place, tell a friend where you're going, etc.).

We do not conduct background checks or verify the identity or criminal history of users, and we do not guarantee that any meetup or interaction will be safe or meet your expectations. You assume all risks arising from your interactions with others through our Services or at any events. This includes any risk of physical or emotional injury, illness, damage, or loss.

To the fullest extent permitted by law, you agree to release and hold harmless Find Your Tribe LLC and its officers, employees, agents, and affiliates from any claims or liabilities related to any harm or damage arising out of or in connection with your interactions with other users, meetups you organize or attend, or any user-contributed content. We are not responsible for what happens in the real world, as we cannot control the actions of individual users.

7. Community Safety, Moderation & Enforcement

Summary: We have zero tolerance for harmful content or behavior. We use a combination of automated systems and human moderators to keep the community safe. You can report bad behavior or content, and we will take action (often within 24 hours). We may remove content or users who violate our rules. If your content is removed or your account is restricted, you will be given a reason and can appeal the decision.

  • Zero Tolerance: We maintain a zero-tolerance policy for objectionable content and abusive behavior. Users who violate these rules may face immediate consequences including content removal, feature limitations, account suspension, or termination without notice.
  • User Reporting & Blocking: Our app provides in-app tools for you to report inappropriate content or behavior and to block other users. You can also email us at moderation@wefindyourtribe.com to report issues. We encourage you to report anything that violates these Terms or makes you or others feel unsafe. We will review reports promptly.
  • Moderation Practices: We use a combination of automated filters and human moderators to help keep the platform safe. For example, we employ automated image filters to block or blur explicit images. We also monitor for spam or bot activity. Our team may screen or review content that is posted, especially when it's flagged by users. We reserve the right to remove or restrict any content or accounts that violate our Terms or policies. We strive to address reported content in a timely manner (generally within 24 hours).
  • Notice of Action & Appeal: If we remove your content or suspend/terminate your account, we will where feasible inform you of the reason in-app or via email. If you believe we made a mistake, you may appeal by contacting us at moderation@wefindyourtribe.com. We will review appeals fairly. European Union users: this process is designed to meet the EU Digital Services Act requirements for notice and appeal.

7A. Child Safety and Protection Standards

7A.1 Overview

Gather by We Find Your Tribe LLC is committed to maintaining the highest standards of safety and care within our community. We strictly prohibit any activity or content that exploits, endangers, or harms children. These standards apply to all users of the Gather app and related services.

7A.2 Zero Tolerance for Child Sexual Exploitation or Abuse

We maintain a zero-tolerance policy toward any form of Child Sexual Exploitation or Abuse ("CSEA") and Child Sexual Abuse Material ("CSAM").

  • The creation, possession, distribution, solicitation, or promotion of CSEA or CSAM is strictly prohibited on Gather.
  • Any user who engages in or attempts to engage in such conduct will be immediately and permanently removed from the platform, and their information will be reported to law enforcement and the National Center for Missing & Exploited Children (NCMEC) or equivalent authorities as required by law.
  • This prohibition extends to any behavior, communication, or content that endangers or targets minors or facilitates their exploitation in any way.

7A.3 Age Restrictions

Gather is intended solely for individuals 21 years of age or older. We take steps to prevent under-age access, including account-creation age attestation, moderation review of reported accounts, and immediate removal of any suspected under-age users.

7A.4 Reporting and User Safety Tools

Users can report inappropriate or illegal content or behavior directly through the in-app reporting tools available on user profiles, chat messages, and event listings. Users can also block or remove other users from communication at any time and submit additional safety concerns or feedback through our in-app feedback mechanism.

All reports are promptly reviewed by our Trust & Safety team, which prioritizes issues involving potential child endangerment or exploitation.

7A.5 Dedicated Child Safety Contact

If you encounter content or behavior that you believe involves or risks child sexual exploitation or abuse, please contact our dedicated child safety team at:

Reports to this address are reviewed and prioritized as soon as possible, typically within 24 hours.

7A.6 Detection, Enforcement, and Cooperation

We use a combination of automated detection systems, human moderation, and user reporting to identify and remove harmful content or behavior. When suspected CSEA or CSAM is identified or reported:

  • The content is immediately removed from our systems.
  • The associated accounts are permanently banned.
  • Relevant data is preserved and reported to NCMEC and/or appropriate law enforcement authorities.

We fully cooperate with law enforcement investigations in accordance with applicable privacy and data protection laws.

7A.7 Legal Compliance

We Find Your Tribe LLC complies with all applicable child safety, privacy, and reporting laws in jurisdictions where Gather operates, including:

  • 18 U.S.C. § 2258A, which requires reporting of CSAM to NCMEC in the United States.
  • U.S. federal and state laws prohibiting child sexual exploitation and abuse.
  • Google Play's Child Safety Standards Policy.

We also follow guidance from NCMEC, INHOPE, and the Technology Coalition and regularly review our child safety policies and moderation processes for compliance and effectiveness.

7A.8 Enforcement and Updates

Violations of this policy will result in immediate enforcement actions, including suspension or termination of accounts and reporting to authorities. We may update this section periodically to reflect changes in applicable law, technology, or platform practices. 8. Copyright (DMCA) – Notice & Takedown (U.S.)

Summary: We respect intellectual property rights. If someone posts content that infringes your copyright, you can send us a takedown notice under the DMCA and we will remove it. We have a designated Copyright Agent to handle these requests. Users whose content is removed for infringement can send a counter-notice if they believe it was a mistake. We will terminate the accounts of repeat infringers.

We respect intellectual property rights and comply with the U.S. Digital Millennium Copyright Act (DMCA). If you believe any content on our platform infringes your copyright, you may send us a Notice of Claimed Infringement to:

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content and notify the user who posted it. That user then has the right to send us a Counter-Notice if they believe the content was removed due to mistake or misidentification.

Repeat Infringers: Users who are repeat copyright infringers will have their accounts terminated.

9. EU Digital Services Act – Notice & Action (For EU Users)

Summary: If you are using our Services in the European Union, you have the right to notify us about illegal content. We provide a specific process to do so. We will review and act on such notices expeditiously, and if we remove content for being illegal, we'll give you a brief explanation and offer a way to appeal. We also have a special contact email for EU regulatory queries.

If you are in the European Union, you may report content or activity that you believe is illegal using our "notice and action" mechanism:

  • How to Notify: Use the in-app reporting tool or email us at dsa@wefindyourtribe.com. Please provide: a description of the content (and why you believe it is illegal), steps to locate it, the law or legal basis it allegedly violates, and your contact information.
  • Our Response: We will promptly acknowledge and diligently evaluate your notice. If the content is indeed unlawful or violates our Terms, we will remove or disable access to it in a timely manner. We will then inform the affected user of the removal and provide them a short statement of reasons. We will also inform you of the outcome of your notice.
  • Appeals: If your content was removed or your account was restricted due to an EU notice or otherwise, you can appeal the decision. Follow the instructions in the removal notice or email moderation@wefindyourtribe.com with your reasons for appeal. We will review appeals impartially.
  • Single Point of Contact: In compliance with the DSA, we maintain a single point of contact in the EU for authorities or regulators. That contact email is dsa@wefindyourtribe.com.

10. Payments and Subscriptions (If and when introduced)

Summary: Right now the app is free, but we may offer paid features later. If we do, by using them you agree to the pricing and terms. Paid subscriptions will auto-renew unless canceled. We will clearly tell you the price, billing interval, and how to cancel before you pay. Generally, fees are non-refundable unless required by law.

Our Services may evolve to include optional paid features or subscription plans. If you choose to subscribe or make any in-app purchase in the future:

  • You agree to pay any fees disclosed for those services, plus any applicable taxes.
  • Auto-Renewal: If the service is offered as a subscription, it may automatically renew at the end of each billing period until you cancel.
  • We will give you an easy way to cancel auto-renewal at any time.
  • No Refunds (with exceptions): All charges are non-refundable once paid, except where required by law or explicitly stated otherwise.

11. Disclaimers

Summary: We provide our services "as is." Sometimes things might not work perfectly, or content might not be accurate. We make no guarantees that the platform will meet all your expectations or be error-free.

Use of the Services is at your own risk. To the maximum extent permitted by law, the Services and all content on them are provided "AS IS" and "AS AVAILABLE," without warranties of any kind. We expressly disclaim any and all warranties and conditions of any kind, whether express, implied, or statutory.

In particular, we do not guarantee: that the Services will be uninterrupted, secure, or error-free; that content will be accurate or reliable; or that events organized through our platform will meet your expectations.

12. Limitation of Liability

Summary: We are not responsible for indirect damages or things we can't reasonably foresee. If we do get found liable for something, the amount you can recover from us is limited (capped at what you paid us in the last year or $100, whichever is greater).

To the fullest extent permitted by applicable law, Find Your Tribe LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages. This limitation applies whether or not we have been informed of the possibility of such damages.

Monetary Cap: To the extent we are found liable, our total liability to you for all claims arising out of or related to the Services or these Terms will not exceed the amount (if any) you paid Find Your Tribe LLC in the 12 months immediately before the event that gave rise to your claim, or USD $100, whichever is greater.

13. Indemnification

Summary: If your actions or content cause us to get sued or incur costs, you'll cover those costs.

You agree to defend, indemnify, and hold harmless Find Your Tribe LLC and its affiliates, officers, agents, partners, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or related to:

  • Your Content that you post or share on the Services,
  • Your conduct in connection with the Services (including at meetups or events),
  • Your violation of these Terms or of any law or regulation, or
  • Your violation of any rights of any third party.

14. Export, Sanctions & Compliance

Summary: You agree to follow export control and sanctions laws. If you are on certain government lists or in certain countries, you cannot use our app. Also, use the app only if it's legal to do so in your location.

Our Services are subject to export control and economic sanctions laws of the United States and other jurisdictions. By using the Services, you agree to comply with all such laws and regulations that apply to your access and use.

15. Termination

Summary: We can suspend or terminate your access if needed (especially for rule violations or legal reasons). You can also delete your account whenever you want. Some terms will survive even after an account is closed.

By You: You are free to stop using our Services at any time. You may delete your account via the app's settings or by contacting us at ann@wefindyourtribe.com.

By Us: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if: you have violated these Terms; it's necessary to protect the safety or rights of other users; we are required to do so by law; your account has been inactive for an extended period; or for any other reason in our sole discretion.

16. Dispute Resolution & Governing Law

Summary: Any disputes between us will be resolved by binding arbitration (not in court) on an individual basis, with a limited right to go to small claims court. You waive the right to sue in court or be part of a class-action lawsuit. If you don't want to agree to arbitration, you have 30 days from when you first agree to these Terms to opt out by emailing us. The laws of California (USA) govern these Terms.

Governing Law: These Terms and any dispute arising from your use of the Services are governed by the laws of the State of California, USA, except for its conflict of law principles.

Arbitration Agreement: You and Find Your Tribe LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be resolved through final and binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. This means you are waiving your right to a trial by jury or to participate in a class action for such disputes.

Opt-Out Right: If you do not wish to resolve disputes by arbitration, you may opt out of this arbitration agreement by sending an email to optout@wefindyourtribe.com or a physical letter to our contact address within 30 days of first accepting these Terms. You must include your name, the email or phone number associated with your account, and a clear statement that you want to opt out of arbitration.

Class Action Waiver: To the fullest extent permitted by law, we each agree that any arbitration (or, if allowed, court proceeding) will be conducted only on an individual basis and not in a class, consolidated, or representative action. We each waive any right to a jury trial and to participate in a class action.

17. Changes to Terms

Summary: We can update these Terms from time to time. If we make material changes, we will notify you (via app or email). Once an updated Terms takes effect, your continued use of the app means you accept the new terms. If you don't agree, you should stop using the app and can delete your account.

We may modify or update these Terms of Service from time to time as our business and legal requirements evolve. If we make material changes (meaning changes that significantly affect your rights or obligations), we will provide notice to you by appropriate means, such as by sending an email to the address associated with your account or by displaying a prominent notice within the app. The notice will include the effective date of the updated Terms.

It is important that you review any updated Terms. Changes will not be retroactive – they will become effective no sooner than the date listed in the notice. If you continue to use the Services after the new Terms take effect, you will be deemed to have accepted the updated Terms. If you do not agree to any revised Terms, you should stop using the Services and may delete your account before the changes take effect.
